  • L2 Visa: A Peculiar Question

    Dear All,

I need an L1B for an assignment in US. I need to obtain it as soon as possible. I also intend to take my family (wife and 2 sons) 3 months after I go to US. The issue is that the name on my second son’s passport is printed inaccurately (only first name is printed as given name whereas the family name is not printed at all). My question:

    1. Can I go for L1B stamping (L2 for my family) without correcting my son’s name? I know the question sounds moot as one must correct the name in passport. My argument is (or rather I hope that): my son’s first name is printed correctly and his passport contains names of both me and my wife; is it not enough? Moreover if I get the L2 for him, will there be challenges during the travel? By the way, my this son is 3 years old (if that has any relevance). Given the answer to this question is not likely in affirmative, my next question.

    2. Can I go for L1B stamping with my wife and the son whose passport is all good? Meanwhile I will apply for the name change for my second son. I will go once again (or just send my wife if I happen to be in US that time) for the stamping for my second son? Since this is more hassle for me, my next question.

    3. Is it no harm if I went for L1 stamping alone; and once my son’s passport is corrected, my family goes for L2 stamping (with me if I am still in India otherwise without me).

Your advice in this regard will be much appreciated.

Any option will work. It is always better to get the name corrected in the passport before getting the visa. I think the best option is, You get L1 first (if you cannot wait until son's passport correction) and then your dependents can go for stamping. I did so (no passport correction was needed though.)

      1. Given the fact that the name printed in the passport is not wrong you can go ahead with the existing passport. The only problem with this approach is that you will end up with the dreaded FNU issue. This should not affect your son's stay in the US anyway as he is too young to apply for important documents such as SSN or Driver's license.

2,3. It is better that all of you as a family attend the interview. You will have a better chance of VISA approval as compared to attending the interview individually...

Can I Travel without Police Verification

Thanks "mad_sudhan" and "goomail" for your time and replies. Much appreciated. I will just use my second son’s passport as is. I also happen to meet a couple of people in passport office and they assured that this is not an issue.

Now I have another issue though. My passport is issued without the police verification. A police had come to my house a couple of months back. I was at office at the time; he asked my wife to send me to the police station asap. As you guessed right, given it was not urgent then, I didn’t go to police station then. I did go to there today though. The policeman asked me about time since this case is pending. He told me that they don’t keep the cases for more than 15 days and they would have sent the file back to passport office. He didn’t care to check if the file was still there. He further told me to re-initiate the police verification process. Given I need to travel urgently, I asked him whether I could travel without the police verification (how dumb and wishful of me to ask this question to a policeman). He said no and that my passport will be seized at immigration. My earlier research on this subject, I have had found that I can travel without the police verification. After this episode, I am doubtful again. Any first/second-hand experience on this issue? Any suggestions? It will be much appreciated.

            PCC needed

I was in similar situation when i got my passport renewed.. Came on Vacation from US and missed the police verification as i was travelling. Got a call from police station before a week of my departure and cleared the formalities.. (Came to know on that day that without clearance, passport will be flagged and you cant leave India itself). Basically the commissioner office will send a clearance certificate once your signed police verification letter reaches them. It took me only a day to get everything cleared...

            Hope this helps..
