  • L2 to H1 transition

    Hi I have L2 with company A and H1 with company B (effective from 1st oct), I have plan to join company B on 1st oct. I will resign from company A couple of week ealier 17 Sep. Now as we have 29 sep and 30 sep are satureday and sunday, my last working day will be 28 Sep. So technical I will not have any status for couple of day? is this going to be a problem in getting visa stamped in future?

    You will remain to be in L2 status until Oct 1st. There is no compulsion that L2 should work to maintain the status. I see no issues.

      thnaks, Also Can me or my wife (L2 visa) can go to india and come back before 1 oct with out stamping (we have h1b petition approved from 1 oct)

        That is not advisable. Whether the previously approved change of status remains valid or not becomes a matter of confusion. If she leave the US, she should obtain H1B Visa and return in H1 status on or after Oct 1.

          Who is in L2 status? You or your wife? In the very first post you mentioned you are in L2 and later you have mentioned your wife is in L2. Unless you frame your question correctly you are not going to get a correct response. The answers provided might not be accurate when answered under assumptions.

            Srry for Confusion. I am on L1B and my wife on L2. Let me ask question again.

            I have L1B with company A and H1 with company B (effective from 1st oct), I have plan to join company B on 1st oct. I will resign from company A couple of week ealier 17 Sep. Now as we have 29 sep and 30 sep are satureday and sunday, my last working day will be 28 Sep or ealier than 28 Sep (but las woking day will be between 24 sep and 28 sep ). So technical I will not have any status for couple of day? is this going to be a problem in getting visa stamped in future?

              National holidays and weekends are not a reason to worry about being out of status. A coupe of days between one employer to another will not create any issues. If possible, see to that your last working day with the current employer is 28th Sept so that you can join the new one on Oct 1st in which case there are no out of status period.

                A couple of days or weekends is generally not a problem at all.
