  • L1 extension

    Hi,

    My L1B visa is set to expire on 22Oct2012, while I94 is stamped till 13May2015. I started working in US from 01Dec2009. Please advise :
    • Do I have to apply for visa extension/renewal since my visa expires in Oct12?
    • Also if I don't extend/renew my visa, would I be able to legally work just on I94?
    • Can I stay/work till 2015? as I understand L1B initial stay is valid for 3 years.
    • I have applied for my spouse EAD. Her I94 is also valid upto May2015, but since my visa is valid upto Oct12, will she get authorization till Oct12 or for later date?


    Appreciate your help.

    • Can I stay/work till 2015? as I understand L1B initial stay is valid for 3 years. Total duration of stay in the US in L1B status is 5 years. If your current I-94 is of a longer duration, you should leave the US after you finish total 5 years of stay in the US in L1B status.

If she attached a copy of her I-94 with the application, it should be as per I-94 date. Even if it is not, she can apply for renewal based on the I-94 again.

    Note that if you or your spouse leaves the US any time after Visa expiry, you will have to apply for the Visa again at a Consulate/Embassy in order to return.

      Thank you Kabkaba. Just one more question. In the event I apply for extension and that gets denied, can i still stay and work since I94 has stamped date of 2015?
