L1B Visa expired but I-129S is still valid

Hi,

My L1 Visa expired on 13th May 2012, but my petition expiry date is 31st April 2013. I did not travel to the USA till now. I am planning to go to the USA in August 2012. What is the process i should follow for renewing my Visa? Should i attend the Visa interview again? Should i file the petition again?

You have to apply for the visa again. Why was the visa issued for a duration less than the petition expiry date? Was your passport expiring within 1 year? If yes, then you need to renew your passport before you appear for the visa interview. Usually visa is issued until the petition expiry date unless the passport is expiring within 1 year as of the date of the visa interview.

Thanks for your reply. My passport expiry date is till 2017. I m not sure why they did not give me visa till my petition expiry date.

You mentioned that i need to reapply for the visa. Does this mean that i need to file a new petition again or i can apply for the visa on the existing petition?

You can apply for the visa based on the existing valid petition. Keep in mind the visa will be issued only till the petition expiry date.

How else are you planning to get the visa stamped in your passport without attending the visa interview? Is there any other way?
