  • L1B Extension RFE

    Hi,

    I have filed L1B extension thru my employer and got RFE for the same.

    My employer is giving an option to go for canada and get stamped l1 blanket.

    Or submit the documents for RFE. But the rejection rate is more high.

    My I94 is expiring on OCT 2,2012.

    I have two options now
    1. Go to Canada and get l1blanket stamped
    2. Proceed with RFE with documents.

    I am exploring third option to ask my employer apply for H1B conversion and withdraw a L1B extension?

    Please suggest me which one to go for it.

    I doubt if you will have time to send the H1B application on time before the CAP closes. But you can ask the employer to start the process and try. If it doesn't work, then withdraw the L1 extension, leave the country before the I-94 expires and return back on a valid L1 visa and L1 blanket petition.

        Yes. In case of rejection (just in case), you need to be prepared to go back to your home country from there. In case of an RFE, you may have to stay there for a more duration than expected. Just be prepared for the worst as you cannot 100% predict what might happen during a visa interview.

          I have few more questions.

          1. If i proceed with RFE and in worst case got rejected, Shall I go for CANADA L1 Blanket after that since I have 4 months left in I94?
          2. Is there period that I cannot apply for new visa after extension rejected?
