  • L1B transfer possible even if client was not awarded to my company

    Hi,

Please note I am confused and really appreciate if some one can throw some light. I have a valid L1B(l2) for client X in our organisation. Now due to some reasons the engagement didn't work and the client did not come on board. Now the VISA cell in my company is suggesting that my L!B cannot be used because we didn't win the engagement and hence the possibility of transfer s ruled out.

I have been through VISA policy for L1B and did not find anything related to above restriction.I have been told that If i travel to US and then consulate inquires from X client then I may be deported and my organisation could earn bad name as well.

    My questions

1)Is transfer possible? as L1b is intercompany transfer and not client specific.the client name is provided in DS160 only and not on VISa
2)Is there any check from US consulate on my arrival in US and is my client checked on it.?
    3) what if we go and work from our office in US and sit at client location?
    4) My company is suggesting to raise L1 again but i think it will be not worth and may end up rejecting the current valid L1B as well.

Someone please guide me on this as I understand its just our company's internal policy and not related to VISA policy.

    Regards

This is purely your company's policy. There is no such rule. L1B is issued based on your specialized skills that you will be applying for a particular engagement - and in fact the petition itself calls it "proposed nature of employment" which in other words means it can change.

When you travel for a client other than the one mentioned on your petition; you dont need any kind of modified document.
