Question regarding L1 Extention

Hi,

My I-94 and visa expiring on Sep 8 2012(L1 and L2).
I had applied for L1 extention through my employer under premium processing .
What are the chances of getting RFE for L1 nowadays and how long can i stay on RFE status.
If extention is rejected around Sep , and wife cannot travel after Aug as she is 7 Months pregnant now.
Can we mention medical reasons while applying L1 extention?

When did you apply for Extension? If applied in premium you should get a response within 15 Days. As of chances of RFE, no one can predict as its all case to case basis. If extension is rejected then you would have to leave immediately as any stay beyond I-94 expiry is considered illegal. Also, the stay beyond I-94 would be considered legal only if your extension eventually gets approved. Medical reason is not a valid reason to stay beyond I-94 expiry as one is allowed to file for extension 6 Months before I-94 expiry and you could have very well filed the extension in March 2012 itself to have got a decision by now. This is my opinion, not legal advice.
