  • L1 B (Blanket) or H1 B after L1 B (Individual) and B1/B2 Rejection

    Hi,

My company (Global MNC) applied for L1 B (Individual) 4 months back and filed petition in US, first i got RFE and then finally the petition was denied on grounds of lack of evidences to prove my specialized knowledge .
Around the time of the verdict, i also had applied for B1/B2 which also got rejected , i still don't know the reason.

Attorney suggested to go for H1B and refile L1 B under Blanket option.
We have filed for H1 B , against which we again have got RFE and in the process of responding to the RFE by this month end.
In parallel , Attorney has prepared application for L1-B Blanket which shall be sent to me to make a local appointment for Visa Interview. I should be getting the I-797 form by next week.

Considering the last unfortunate events of L1 B and B1/B2 rejections and alarmingly high rate of L1 B Blanket rejections in India, do you suggest i should go for L1 B Blanket interview first or should wait till there is a verdict from H1 B.

Its a complex case so seeking advise to play it ultra safe .

Everytime you apply for a visa, your qualification, experiences, skills and merits will be analyzed to see if you are eligible for the visa/petition that you are applying. So it doesn;'t really matter whether you try L1B first or H1B first. If L1 individual is rejected on the grounds that you do not pose the required skills, then the chnaces of L1B is light. L1B get more scrutinity these days compared to L1 individual. H1B may be the way to go.
Not a legal advice. Use of this information is strictly at your own risk.
