L1 individual visa expired but still working remotely .

Hi All,

I am on L1 Individual visa and it was valid till July 20 2012. I attended H1 interview at Hyderabad consulate on Jun 25 2012 hoping that I would get my H1 visa before L1 expires and go back to US continue my work on H1 visa . But , my H1 visa stamping is still pending ,no update from US consulate yet. L1 and H1 visa are from same company and work location is same . H1 visa my company filed is Overseas Notification . My question is " Is it legal for my company to generate payslip in August on my name as I am working remotely from India as I am waiting on H1 visa to be stamped ? Please let me know .
