l1b individual petition got rfe

HI All,

I submitted L1B individual petition in month of may. I received rfe fro uscis last week.

RFE is more about providing documentation to proof "Specialized Knowladge Worker" and i heard that

chances going to be rare once you received RFE.

I already got L1B blanket petition rejected last year. So i am planning to withdraw l1b individual petition.

Does this affect my future visa process. Please reply.. i am in confused stat.. if i continue my visa process by submitting rfe but chances are rare. getting visa.

and second option to withdraw this petition that i belive best one.. withdrawing is better than rejection.

Please advice ASAP....

You should definitely respond to the rfe. Withdrawing wont help your case anyway. By responding you are giving yourself a chance and if your application is documented properly, the rfe response is convincing, you might just get it approved

I got L1B visa rejected then i applied for L1B individual so if rejected this time then it impacts bad on my future visas
and i already i got rfe so chances becomes rare.......
If i left company then its ok to withdraw petition ......would it impact bad on my future visa...

You may be questioned about it in future visa applications but withdrawing or not responding to RFE will not have any affect on your future. You can always say that the project requirements changed and there was no necessity for you to travel or that you changed your job, if you did. This is my opinion, not legal advice.

Raghvi, I believe that your visa is considered to be denied only when you appear for an interview and do not get it stamped because the VO feels otherwise. If it is just a petition, that does not qualify as a denied visa. This is per my understanding, so I think there is no harm is responding to the RFE - if there is a petition denial; it does not matter as such - and if it gets accepted; then the chances of a succesfull visa stamping are high
