    Hello Seniors,

    My L1 Blanket visa is till Sep 29 2012 and my I-94 is also valid till the same date. My company is applying extension for blanket visa. We have been told by HR that they will apply the extension before our I94 expires and we can stay 240 days after I-94 expiration waiting for the extension result. Is this correct? Do we have to face any consequences for future visa applications with USCIS if we stay beyond the I-94 extension.

    Please advise how can i handle this situation.

    Your HR should also know that USCIS also allows one to file extension 6 Months before I-94 expiry. It is not advisable to wait till last moment to do so. Though partly true that you can stay upto 240 Days based on an extension filed receipt I would personally not advise it because if the extension gets rejected all days of your stay after I-94 Expiry would be considered illegal. Illegal stay can cause issues with future Visa processing and stampings. Companies and their lawyers are rarely impacted its the employees who get adversely affected. This is my opinion not legal advice.

      Thanks a lot Raghvi for the quick reply.

      So with 2 months of time availble before my I-94 expires and My HR confirmed that they will not apply the case in premium
      processing, do you think I will be able to complete the renewal process via normal processing before Sep 29 2012.
      How many days it will take generally for regular processing and I heard we should be good for 45 days with normal processing, is this correct?

      Can any one of the seniors can also explain other viable options, I have also asked my HR that i will bear the premium
      processing cost and they declined it and say its better we go with normal processing to avoid any RFEs for premium?

        Can anyone please reply to my previous post?

        And also my wife is working on L2 EAD and her EAD is valid till Apr 2013(based on my previous I-94). Her employer applied her H1-B with cap exemption recently and we are waiting for result.

        However in any case if H1-B doesn't workout, can she be eligible to work on L2 EAD based on my situation here, I mean if we don't hear the L1 extension outcome before my I-94 expires. My employer is also applying for L2 extension and my spouse has her I-94 till Mar 2014.

        Please advise.
