  • Can I extend my ONE year valid R-1 Visa to 3 Years without going abroad?

I got 3 years R1 Contract from USA. When I obtained my R1 Visa and R2 for my family, the US Consulate in India stamped only a 1 year visa on our passport even though we applied for a 3 year visa. But upon my entry to US, the POE officer gave us a 3 year I-94

My current R1 visa is expiring in Nov.09 as per US Visa stamped on my passport.

    My Question:

If I travel to the country (India) after Nov 09, in order to come back to US what all should I do?

Do I need to apply for a new R1 Visa ?

    or

Is it any chance that The US Consulate can extend the visa without going through the whole process, based on my R1 Contract & valid I 94 for approximately 3years ?

    or

Can Extend my R1 Visa from USA without going back to India
since I have my 3 year R1 Contract and -I 94 good for 3 years?

    You advice is greatly appreciated.

From what US Consulate/Embassy you got your initial R1 visa? When you applied for it what was the length of your offered employment in US?

Yes, you need apply in new R-1 visa at a US Embassy, because your I-94 good for your staying only, not for your entering to US.

The rule has changed, be careful.
You will need an approved I-129 from USCIS to getting R-1 visa.
