    Hi,

    Thanks for helping out. I am a minister, working full time for my church now as Pastor. I am currently in USA.

    My question is:

    1. I just got my R1 visa approved this month. For some reason, my lawyer did a mistake, instead of asking for 3 years, he put it at 2 years, which will expire in end of September 2012. My Question is, if I want to apply for an extension, can I do it for 3 years, not 2 years? I know the limit (initial + after extension) cannot exceed 5 years period.

    2. After 2 years, my lawyer said that I can start my Greencard process. Is it true that I have to be under "W2 status - employee" within this 2 years, not "1099 status - independent contractor" to be eligible to apply for the Greencard? The amount is the same, it's just how my church is going to pay for it during this 2 years, whether it is through W2 or 1099. Anybody has an idea on this?

    It's just too much hassle in terms of paper work for my church to pay me as W2 employee, instead of 1099 (independent contractor).
