H1b- to F1 change of status, PhD, (Travel to india), PASSPORT expiry

My current situation:
Working on an H1-B for employer and intend to pursue a PhD starting Jan 2013. I had received admit for FALL 2012 and applied for change of status (I-539) within the US, but withdrew my application at last moment as i had some other issues. Asked the university for another deferred i-20 and they provided me one.

My plan is to visit India in November and get my change of status to F1. I had the following questions


*Since i withdrew my COS will it affect my decision in anyway at the US embassy in INDIA?
*My passport validity is till June 2014, and PhD program end date on i-20 mentions as 2016. Will i need to renew my passport as i read somewhere that my passport needs to be valid for entire duration of study? . Again a major aspect for passport renewal which i inquired at Indian embassy in the US is that it can be only done one year before the validity of passport expires. IS it true?
*Suppose my F1 gets denied will i still be able to enter US on my current H1 (or is there a possibility that they may even cancel my H1 visa?)
*I have been in the US for 5 years now 3 yrs on F1 (for MS) and 2 yrs on H1 and now planning to go back to F1 (for PhD)

I am also currently in more or less a similar situation. I want to do a Phd, and I am currently working in the US on H1B. I am interested in knowing what happened in your case, especially how did the process of change of status go.. did having a prior history of F1 and H1 affect the visa inerviewr's decision?

Hey...i have the same situation. I am planning to go to India to get my F1 stamped. My spouse who is now on h4 will be applying for a F2 visa? Can you guide as to what happened with your case..

Student Visa

I have been in the USA about 10 months. I have student visa (F1). I m forreigner. The problem is that 1.5 months ago, I finnished my school and they told me ‘you can stay here 2 months.’ Then, this two months is going to be finish on July 23 but my flight ticket (for turning back to my country) is on August 1 and I m not able to change my flight ticket. What should I do?

What is the date on your i-94? You shouldn't have overstayed the date past the one mentioned on your i-94 otherwise I'm sorry to say you'll be out of status for that duration of time .
