  • F1 OPT Visa - Travelling to India in between change in initial OPT period

    Hi,

My Opt started on 2nd April, 2015. I joined Consultancy to maintain my visa status and was under training period ( Didn't recieved any salary while on training).
Now I got a job in my electronics field and whose joining is on 22nd August.

So I plan to travel India before I start. So My question is can I enter united states without any problem? I mean while entering USA I just have to show my new offer letter, EAD Card, Passport, I-20, I-94 and no need of showing previous employer offer letter or Payslips/Paystubs etc, right?

Do they ask for your previous 3 months salary slips/pay slips/pay stubs,? As I didn't recieved any salary in consultancy. will there be a problem while returning back usa.?

I have uploaded my new offer letter to my university system so that they can change it in sevis system.

I look forward to your reply.

From my Understanding of OPT which I had, is that you should be able to get back in (in the information session I attended when I accquired my OPT, they really expressed that there's no guarantee even if you do have an offer) to increase the chance of you getting back in, have following that you have mentioned like letter explaining your job and when it starts etc... What you have to be careful is that if you are not currently working (if you are between job from your unpaid job, to the job you have lined up), those days will count towards "unemployed" days they tell you about which you have 90days grace period including the weekend and holidays. So with that being said, although you do not need your paystub since you didn't get paid. I will recommend you getting the letter verifying your job at the previous work just to be safe.

If you are unsure, just contact your International office that you attended university!

    Good Luck!

Most important thing is to report your employment status to your school's DSO. As long as you did that, you should be fine. Remember that time spent abroad counts as unemployment.
This is my opinion and not legal advice.
