  • H4 to F1 Conversion Process- Queries

    Hello Friends,

    I have a very specific query for my visa conversion process.

    Below is my case, and followed are the queries-
    - I live and work in India, but my wife lives and works in the US on a H1B.
    - I travel often and have a H4 Visa for myself, which expires in 2017.
    - I have been admitted to a couple of Teir 1 universities for my MBA and would be joining Fall 2016 for a 2 years program (2016 to 2018).

    Queries-
    1) Since I have an H4, I want to convert it to F1 from India. Would it need a fresh Visa application (DS160) or a conversion application (I539)?
    2) Once I apply and get my F1, what happens to my H4 visa status?
    3) I am planning to travel to the US during my new visa application, would it have any impact?

      Hi,

      I would recommend below options.

      Option 1:

      a) Go for F1 stamping in India.

      b) If you get the Visa, Travel with F1

      Option 2:

      a) If F1 is rejected, travel to USA on H4

      b) Join college on H4 and apply for Change Of Status from H4 to F1.

      c) Vermont Service Center takes very long time. Prefer to send to California Service Center.

        H4 visa

        Currently i am on a H4 dependent visa. I have enrolled for xyz university in Spring 2014 on H4 visa only (havn't applied for H4 to F1 visa conversion). Due to some work related issues we are planning to travel to India for more than 6months. My question is:
        Is it ok if i return to US on F1 visa by applying F1 visa in India while coming to US? WHat are the problems will i face if i apply for F1 visa in India? Is it a better idea to take a break of 6months during educations? Does this gap create any problems in furture?
