  • TN Visa application

    Hi,

If the company filed for I 140 in L1A with my Indian passport, then I became a Canadian citizen. will there be an impact if I file for a TN visa?

While there shouldn't be a direct impact on your TN visa application due to your previous L-1A petition with an Indian passport and subsequent Canadian citizenship, there are a few factors to consider:

    1. Purpose of L-1A petition:
    • The purpose of your previous L-1A petition may raise questions about your intention for the TN visa. If your L-1A was for a specialized knowledge position, it might raise concerns about your eligibility for a TN professional occupation.
    • Be prepared to clearly explain the differences between your L-1A and TN roles, highlighting their distinct specializations and how they fall under different TN categories.

    2. Maintaining status:
    • Ensure you maintained lawful status throughout your L-1A period and any subsequent transitions. Any violations or overstays could negatively impact your TN application.
    • Gather documentation proving your lawful presence in the US during your L-1A period and any relevant information regarding your Canadian citizenship acquisition.

    3. Canadian residency:
    • You must demonstrate you have a primary residence in Canada and maintain strong ties to the country.
    • Provide evidence such as tax returns, property ownership, family connections, and other proof of residency to support your claim.

    4. TN occupation and qualifications:
    • Ensure your intended TN occupation falls under a pre-approved TN category and possesses the necessary educational and professional qualifications outlined for that specific category.

    5. Disclosing previous L-1A petition:
    • Be upfront and transparent about your previous L-1A petition during your TN application. Disclose this information clearly and accurately in your application and be prepared to answer any questions regarding it.

    Here are some additional recommendations:
    • Consult with an immigration attorney specializing in TN visas. They can provide personalized guidance based on your specific circumstances and help navigate the application process effectively.
    • Gather all relevant documentation supporting your TN eligibility, including proof of Canadian citizenship, TN occupation qualifications, and lawful status history.
    • Prepare for a possible interview at the US port of entry or consulate. Be prepared to explain your L-1A history and answer any questions about your TN application clearly and confidently.

By proactively addressing these considerations and diligently omegle preparing owespeedtest your application, you can increase your chances of obtaining a TN visa despite your previous L-1A petition. Remember, transparency and clear communication are key when dealing with immigration authorities.

Hi thank you for the detailed answers. I got laid off recently while I am on my L1 due to economic conditions. This is on the executive Manager and not specialized visa. I am planning to come back to Canada later this year for a few days to avoid the over stay of more than 60 days. And return to USA as Canadian citizen to wrap up my apartment and other things. While I am trying to find a job and in midst of giving interviews, Will All the above you said is valid or it changes things?

The North American Free Trade Agreement (NAFTA) serves as the foundation for the TN visa, which is only available to residents of Canada and Mexico. Even after obtaining Canadian citizenship, you are still eligible to apply for a TN visa. It should not affect your eligibility for the TN visa if you are now a Canadian citizen instead of an Indian one.
