  • DV program and VWP issue

    Hi all,

I'm living in France (I'm French), I studied in the US two years ago with a student visa, and I entered the 2016-DV program, so I'll have the answer in May. However, I'm going back to the US in July just for a two-week vacation. Since France is eligible for the VWP, I wanted to know if I won't get any trouble using ESTA because of my application to the lottery.
In addition, I'll be traveling alone, I am young, not married and unemployed in France (enrolled at university though).
Some people told me that if I ever get selected at the lottery, I should not fill the form and everything will be alright.
If anyone can help me, it'd be very nice! Thanks

Your application to the Diversity Visa Program is not a visa application. Therefore, if you are not selected, it is not the same as having been denied a visa. Make sure you bring enough funds to support yourself, have a roundtrip flight and that you have an address of a place that you will be staying for your vacation. Your student ID might also be helpful if the officer asks about your student status in France. If you are not otherwise inadmissible (for example you departed within 30-60 days depending on which type of student visa you had) then you should be fine.
*Always be truthful and as forthcoming with information as possible during visa/admission/adjudication interviews. If it is discovered that you have misrepresented yourself during processing the penalties can be severe.*

Thanks for your quick answer! I'm gonna get ESTA and carry with me as many funds as I can. If never I am pre-selected for the DVP, I won't send anything to the KCC then.
