Vwp overstayer

Hi everyone im writing cause i need some answers.Hope fully someone out there can hel me.

Im a NZ citizen i came here in 2005 n stayed here ever since,so im overstayer,have been for almost 5 years now.So i wondering if my husband can petition me while hes a green card holder? and if he can would i have to leave the country?
