  • VISA Rejected for my Parents at Mumbai Consulate on 31st Dec 2012

    Hi,

I need an advice on how to re apply for my parents visa? The duration shown was 4 months.Their visa was rejected under 214(b)

They were asked just 4 questions
    1. Why are you going?
    2. What is your son-in-law doing?
    3. Where are you working? (My dad is working in a private company and mom is homemaker)
    4. How many kids do you have? (I am their only daughter)

That's all ...and they rejected the visa.

I have few questions on re-applying:
    1. Can i re-apply immediately? or what gap should i keep before reapplying?
    2. What major change should i should show in the new application?
    3. If i reduce the duration will that help?
    4. I am sponsoring their visit. Will it help if they sponsor themselves?
    5. Will it help if i only apply for my mom and not for my dad?

'Only child in US' is the reason for denial.

    You cannot change that .

You could wait a few months; let your mother apply alone
for a short stay. If your dad's monthly income is 1lac or plus , he can fund the trip.
If not, you can send the I-134.
They will ask her why her husband is not going, she better have a convincing answer.

There have been denials even with one parent applying alone, so all you can do is try.

I have few questions on re-applying:
      1. Can i re-apply immediately? or what gap should i keep before reapplying? -- No rule, but it is better to wait 6 months.
      2. What major change should i should show in the new application? -- The truth.
      3. If i reduce the duration will that help? -- Yes.
      4. I am sponsoring their visit. Will it help if they sponsor themselves? -- Yes, but less likely.
      5. Will it help if i only apply for my mom and not for my dad? -- You don't apply for anyone, they apply for themselves. With a previous denial, this may help but better do it after a gap.
Traveling to visit the only daughter in Winter draws attention towards possibility of helping in childbirth, which is not an acceptable reason.
This is my opinion and not legal advice.

My Mom's visa got rejected four times at mumbai consulate.1st and 2nd attempt in May 2010 , 3rd and 4th in Jan 2011, each time with same reason - 214(b). In last attempt, even took the help from local Congressman but in vain.

She is 60+ years old and widow.Living with my elder brother's family comprising of Sister-In-law and 3 kids.Mom owns that house and gets monthly income from Dad's pension plus Life time Medical benefit from Dad's service. She carried all documents in each visit.Since her elder son posted in Assam and daughter-in-law suffered from MS and cancer ,she carried all medical report as to prove strong tie-up back home and she will return in short period. But even with all thse her visa rejected....

Here are the question asked during her last 2 visits and are pretty straight forward:
1.Why you want to go? To see new grandson.
2.Do you have daughter? No just 2 son
3.What they do? Elder is in India and younger is in US
        4.How much elder earn? 2L/annum
        5.Younger filed GC? Yes
6.Have you made any foreign visit earlier? No ( This question they asked in 3rd and 4th attempt)

Thats it... sorry cann't give you visa. Today checked with Congresman office do they know any specific reason of denial, office replied 214(g) - lack of strong tie-ups.

I am planning another attempt after a gap of 1 year, please suggests what can be done and what all documents would be needed?

FOr last 1 year she have been living into near-by rental house in order to complete the reconstruction of house. Will this be of any help?

        Thanks in advance

Have you got the GC yet? When did you get it ? What is your wife's visa staus?

What is your mother's education? Has she ever worked ? Is she in good health to show some work?
