  • Parents Visa Rejected twice - Applying again within one year, different consulate?

    Hi All,

I need help with my parents visitor visa. My sister lives in chicago and she is on H-4.
They had applied for the visa last year and both times they were invited by my brother-in-law (H-1)
I am a masters student at Arizona and my dad is a retired goverment employee and mom is a houswife.
They were rejected visa on both occasions at Mumbai consulate.
Now I plan to apply for their visas again but now I will be calling them for my graduation. Also I plan to apply for their visa in Mumbai and schedule the interview at Chennai. And it is within 12months from their last rejection.

Is it ok what I plan to do? Any suggestions?

No. Just the two of us.
My sister is in chicago and I am in Arizona.

But she is in bangalore for vacation and I plan to apply when she is there.
So while applying I am thinking of saying that she has come back for good.

Do you have any suggestions regarding applying from a different consulate within 12 months as their visa was rejected twice from Mumbai.

I do not think changing consulate will matter .
THe main reason for denial is a combo of your dad's retired status + both children in US.
With the same situation, they will keep getting denied.

Plus lying about your sis is not a good idea. Is your bro-in-law back in India too?
Who will show funding for the trip this time? You just graduated and your dad is retired?

My bro-in-law will be in India from March 2nd - March 18 after which they both plan to go back.
Will scheduling an interview during that time help?
Also what other option do I have other than lying that my sister has come back for good. There has to be some major change from last time for them to grant the visa. And I don't think they would come to know about it.
My dad has some savings so he is gonna fund himself.

What do you suggest me to do in this case? What's the way out?

There is not always a way out for some stereotypical B1/B2 denials.
( examples; retired parents with no children in India ; widows with no children in India; young unsettled recent graduates
going for pleasure trips to US)

One way could have been your dad showing going back to work
( starting a small business or a job for the last year )

Isn't there any other way out other than showing my that my Dad has started a business or working.

Also does applying withing 12 months of rejection have any negative impact on the outcome?

Will going to the interview individually work.
Mom can go 1st and tell Dad is gonna be in India and only she is going.
And then after a few weeks Dad goes for the interview saying that Mom is gonna be back in India and only he is going.
              - will this work???

Your mother could apply alone but still there are no guarantees. Parents should not make the mistake of applying separately. Will get caught easily.
