  • Visitor Visa Over Stay - Please help

    My Mother-in-law visited 4 times in the past. Last time when she visited, she got her I-94 stamped for 1 year and she stayed for 8 months. Is she going to face any problems next time she comes to US? She did not stay beyond her I-94 date however she stayed for 8 months. Please advise me

    It was a mistake by the officer who granted her 1 year. They are not allowed to give more than 6 mos for a B2 status.
    It should have been brought to the attention at the airport or CBP office when you guys noticed it.

    There could be questioning , I am not sure how the CBP computer will display her history when she enters next.

    Have you kept a copy of her I-94? It will be a great help .
    And I suggest talk to a good immigration attorney, before she starts her journey ,as it becomes a technical issue.
    There are some who give free email answers for
    short questions .
