  • B2 or K1, PLease I need advice !!

    I was a GC holder my father won the lottery in 1991 when I was a minor, in 2000 I moved back to my country, and returned in USA for vacation in 2009, the GC was taken from me cuz I was out for too many years, I was issued a temporary GC while I had the temp GC I stayed in the USA for 4 months, I met my boyfriend in the USA then, he's a USA citizen, before my GC expired I returned to my country at the American embassy and completed an I407 form, after that I started travelling to USA with approved ESTA, during the last year I went a few times I never stayed more than 10 days each time. the last time I went this winter the Immigration Officer told that I was not allowed to travel with ESTA anymore, because I had been under removal proceeding before, the American embassy officer when I returned my Temp gc told me the removal proceeding was no longer, because I completed an I407 Form, and I could travel as tourist, which is what I did. I made the untinentionall mistake to overstay my ESTA of 1 day!, now Im back in my country, and Im scared (( if I will ever be issued a B2 visa, or K1 which my boyfriend can help me with. As anyone had a similar experience? canyou pls give some advice, or maybe an Immigration Officer is on this forum?....my intention is not to live in the USA for now. I just want to travel as tourist have time with my boyfriend, before we decide to get married. thanks

    K1 is for fiances (only after you guys are engaged and are sure to marry in the US).

    In your case , you can apply for a B1/B2 but the following
    issues can make the officer deny you;
    * your last overstay .
    *And your past history of being an immigrant.
    *And the purpose of visiting a US citizen BF ( which means you are not likely to return).

    If you can overcome the above in your interview you may succeed.
    *think of a different purpoe of travel
    and Since it was only a day of overstay, sit down and think of a plausible reason that the visa officer
    at the embassy can believe in.

      I overstayed cuz i had surgical procedure done , the last week I was there....Ihave medical report, however It isa surgical procedure that i could have done in my country too when I returned, Im afraid TheEmbassy Officer will say that since it was not a medical Emergency I could have done in my country too, althought it was for me a very difficult decision to make and I had to do it there and then.....the few dAYS after were for recovery with antibiotics and bed rest. would it better then if I dont mention at all that I have a boyfriend there? ...I was an immigrant against my will, I was a minor when my parents took me illigaly to the USA, and I was a minor too when I won the GC!! WOULD IT BE ENOGH if I show that I own a home have a bank account and own a car in my country of residence?....no criminal record anywhere! what other reason can I come up with? do you know anyone with a similar situation? I dont want to move there honestly.....I just want to spend time with him and then decide if we can make the next step....

        You can say about the surgical procedure ; you wanted to get it done in US because of better medical care.
        That should not be a problem.

        The problem is the purpose--
        visiting a USC boyfriend, the officer will think you will get married and won't come back.

        Don't you have any relatives there;; your parents or siblings who won the lottery with you.

          All my family return to my original ........every time I went I Always gave my BF address, should I do that again or will they check who lives there?.....also what happens if my visa is denied.(I pray this wont happen) can I reappeal ......what are chances it gets approved right away or second time around?.......

            You have high chance of denial, in my opinion , I am sorry.

            If you get denied;
            You cannot appeal but you can apply again and again.

              Why is that? I mean what is worse to the eyes of the Embassy Official, the fact that I was previously an immigrant (20 years ago) or I made the really foolish mistake of overstaying 2 days,,,,,what questions should I expect to hear? thank you
