    Hi
    Me and my husband are currently on H1 and my parents are here in US from end of December.
    My mom had taken a sabbatical from her bank manager job for 6 months to spend time with me.
    Due to a family emergency, she is leaving to India today.
    Can she return back to US after 10 days and go back to India as planned before(she was supposed to leave in June first week)?
    Or will there be a problem at Poe when she comes back in ten days.

    Your thoughts are much appreciated. Thanks in advance.

    Not recommeded at all. She will be risking her visa.

    IF they give you 6 months on one visit does not mean the remaining period can be carried over to the next visit.

    The next visit is treated as a new one and questions will be asked for her reason to return so quickly.


    SHe has already spent 3 months, so she should not return for another 5 months.

      And this is exactly why. TS's mother will simply need to explain the situation, and provide proof of her ties to her country, and her return tickets. The most critical part is proof of her ties to her country, as that is what will be the most likely cause of refusal at a POE. She may be diverted to secondary inspection, but I don't see why she should be denied admission. In fact, with her travel she proves that she is financially healthy and has ties to her country. Contrary to popular belief, CBP officers will admit a person unless there is a reason not to, not the other way around.

      Which, if you read TS's post, is not the case. She will most likely be given another 6-month I-94 but since she will be leaving on her originally planned departure date, there will be less than 2 months left.
