  • Visitor Visa denied in 2008 - No documents

    Dear Members

    My mother has 10 years vistors visa which expires in 2014.She came to US 3rd time on 28-May-2007 and I-94 was issued until 28-Nov-2007.
    I applied for extesion in nov 2007.I got a extesion denial letter on last week of Jan 2008 and my mother left to india on feb 5th 2008.

    I thought my mother left in time and no issues.
    I didnt keep any document(Denial letter, Boarding pass..etc) which related to my mother's visa extesion.

    Last week(1-Apr-2013) my mother wants to travel 4th time to US and stopped at Hyderabad Airport immigration.
    The reason they were saying " You were over stayed 3 months in your last visit" and we can not allow you to onboard flight.

    I am planning to send my mother for visa staming again (still old visa is valid until 2014).

    My question here is if we dont have any document for last time denial what is the procedure to go for stamping?

    Pl help me on this.

    Surprising Indian immigration stopping someone based on overstay.

        It must have been the airline who stopped her. Airlines are required to collect traveler information before issuing boarding passes and they verify that with US Government for validity so that they can deny boarding if necessary.

        Since she stayed beyond her I-94 and extension was denied, her Visa is void. She needs to truthfully answer questions related to that in DS160 and unfortunately for her that will impact negatively. Supporting documentation such as extension application receipt, denial notices, travel information etc. can help a little.

          I think Indian immigration acted beyond their capacity.


          YOu may want to talk to an immigration attorney , there is a branch of one US att. in chennai.

          Or if she wishes to reapply, there is no special procedure.
          She will just have to explain herself and take a chance if the officer has a way of confirming her info
          through their data base.

          Anyway, officers don't like people spending long periods with extensions , so tell your mother to
          have a solid reason ready for why she applied for the extension.

            Thanks for the reply. In this case Airlines issued boarding pass then Immigration guys stopped her.
