  • ESTA Help!

    Hi
Really sorry if this is already covered somewhere but I've been doing months of research and finding so much conflicting info... This is our situation-
Couple in our mid-twenties wanting to go on holiday to USA next year, both full time employed and home owners. My partner has 11 convictions from when he was 14-18 including criminal damage, drink driving, behaving in a disorderly manner, and breach of an order. Not great obviously, but he now owns a home and works as a civil servant, very much a different person.
We were all prepared to go through the B2 visa process, despite the cost! Already have police certificate, and have filled in the long application form. Also done alot of research on what documents may help get a yes. I was planning on calling tomorrow to book the interview when I looked at the ETSA question...
"Have you ever been arrested or convicted for an offense or crime involving moral turpitude or a violation related to a controlled substance; or have been arrested or convicted for two or more offenses for which the aggregate sentence to confinement was five years or more; or have been a controlled substance trafficker; or are you seeking entry to engage in criminal or immoral activities?"
The honest answer to this would be no, same as it would be for me. From my research and from speaking to alot of people I have found that for some reason these crimes are not considered moral turpitude?! Which I was surprised at.

Obviously we were prepared to go through the process anyway, but if it really isn't necessary I'd rather not waste the £300+ it;s going to cost with travel expenses from Liverpool to London, and the holidays he will have to take from work. I know from what other people have said that if I call the embassy that they will just tell us to apply anyway.
    Anyone any ideas??
    Much appreciated

You are confused between ESTA and B2 visitors visa.

ESTA is online and no travel to London or any payment is required.

You need to apply for B2 tourist visa. All you can do is take chances.

Hmm, not sure I would take a chance with the ESTA and mark no for that question, even if the offences committed aren't considered moral turpitude. If you do mark no, and things come up at the border, it could get messy. However, why are YOU applying for a visa too? You can use the ESTA. The only issue is that with the VWP you can only stay for 90 days, whereas if his visa is approved, he can stay for 6 months. If you both would like to stay more than 90 days, you'll both need visas.
