  • b2 visa and geting maried to us greencard holder

    Hi , i have some questions . Here is my current situation
    1. I have a b2 visa for 10 year.
    2. I am going to get maried in december 2013 to my bf who is a greenard holder and he gona get his citizenship in dec 2014 not a long way to go.
    Now i have a question that can i go to usa on my vistitor visa once i i applied on a greencard basis or do i need to stay in india

    Another qurstion is that he gona get his citizenship in dec 2014💥. So once he applied for me on a greencard spouse base ,can he switch my case as a US citizen and apply as a new application for me so i can get my greencard early than on previous case. Please answer if anyone know about this

    1. Once your future husband files a green card petition for you after marriage,
    it all depends on the officer at the airport to admit you on a B2 visa.
    You have to prove to them that you will return to India after the visit;
    show short duration, carry a return ticket and some ties to India like proof of a job and leave.

    2. Wife of a green card holder comes under F2A category of immigrant visas. These days for India the wait time for F2A is little less than 2 years.
    So, if your husband files for you in Jan 14, you will get your visa based on F2A late in 2015.
    When your husband becomes a citizen in Dec 14, you can upgrade the petition from F2A to IR ( immediate relative) . Even that will take
    a few months for consular processing in India , so you stand to get visas by both the routes in late 2015 ( give and take a few months).

    So, it is your option to continue with F2A, or to upgrade it .
