  • Help with re-application

I had applied for non-immigrant visa which was denied under section 214(b). I plan to reapply. My purpose of visit is social, to attend a very close friend's wedding. However, when I applied for the visa, I applied for both categories B1/B2 since I intend to meet some of my clients and business associates while I am there. I have a good travel history and have been traveling out of country almost every year in last 5-6 years.

I am going to reapply for the visa, should I use the same categories or just apply for b2?
Also in the application what should be mentioned in the previously applied column?
Should I be explaining everything about my purpose of visit or just mention the application details and outcome?

My last interview was on July 19 and I am trying to schedule the next on July 31 because less than a month is left for the wedding I want to attend?

In the last interview the conversation was:

    VO: Purpose of visit
    me: holiday

VO: what do you do ?
me: own a software development company

    VO: are you married ?
    me: no

VO: Sorry, I can't grant you a visa today...

I searched your forum and found I could reapply. I Any other tips would be much appreciated.

    Thanks

If your intention was holiday + business and if you had rightly applied for B1/B2 visa, why did you mention purpose of your visit as holiday?

You can give it a shot but in most cases if your visa was rejected less than 3 months ago and if you are applying for the same visa again, then you are inviting another rejection. The first question you will be asked if at all is "What has changed in these 10 days?". Figure out a strong answer for that.

What was the duration of stay you had mentioned on your DS 160?

My primary reason was the social event. I believe I did not think through. My stay on ds-160 was 20 days.

You are right nothing has changed but then all the things were not considered either. I was unable to explain the reason to go there. The conversation was short and I was probably nervous.

So are you suggesting there is no chance of getting a visa now? What if I apply only for B2 ?

If you are visiting only for your friends wedding then apply under B2 else B1/B2. This gets a bit tricky because within a week you are slightly changing your purpose.

In case you are asked the purpose of visit or what has changed, say that last time you did not elaborate on your purpose of visit "which is to attend your close friends wedding in the US and meet some of your business associates".

Carry friends invitation letter, wedding card and photograph (if any). There will always be a suspect that no one will spend so much money just to attend wedding of a friend but you have to be honest. See if you can get invitation / meeting letter from couple of business associates. Scanned copies from them would do.

From what I have seen with rejections, chances are slim when the gap is less than 3 months. End of the day you have to decide whether you want to apply or not. If this is an event you can give a miss then don't apply now else if it is extremely important then give it a shot.

Also, let me point out that today is 27th July so it is highly unlikely that you will get 31st July date. Also, if you have not booked your tickets yet it will be very expensive in August.

If you have an established business with strong income and balancehseet , you should have shown your purpose a purely business, NOT hoiday.

The reason is a single person going ALONE on a holiday raises suspicion of immigrant intent.

Usually people going on vacation or wedding ceremonies, go with family members.

USVISITOR1 is correct in mentioning that you will receive another rejection if applying with the same purpose
and changing purpose so soon will not be acceptable.

          Forget about the wedding.
Wait a few months and then apply for your business purpose. Remember you will need to show
          * strong income and established business details in India
          * full details of business agenda/contacts in US.

Well I will give it a shot. I do not want to miss this event. I have foregone my annual vacation to Bali because I wanted to attend this wedding. Weddings are usually once in a life time event for everyone and since all old friends would be getting together after many years for this wedding, I would not like to miss this opportunity to catch up with everyone. I have the invitation card and reservations have been made at the wedding venue for me but I have not booked flights because I was advised not to until my visa is confirmed. I understand the flights may be a little expensive but I am not bothered about a few extra thousands if I get to attend this event.

I would like to know though, in case my application is rejected again, would this affect if I every want to apply again in future?

              Hello

While I am not an expert like peace and usvisitor I think few details like what did you mention as your income and who will sponser you can shed better light?

And believe me while rationale like wedding etc make sense to us for these officers considering they process so many applicants every thing is like a doubt and one can blame them.

Do shed more light on those questions and I truly don't think you should apply again no matter what.

              Thanks

It is a self sponsored trip. My net average monthly income comes out to be around 95k INR. I have been traveling abroad at least once a year and have good travel history. I have been to countries like Switzerland, Japan, China apart from most of the south east asia.

Against the better advice I have already submitted the fee. If I do not apply now, I miss the event and I may not have another major reason to go anytime soon. If my application is rejected I guess I have nothing to lose except $160 under current situation.

I dont think there is any statistic which proves that if your visa is rejected it affects your chance the next time you apply. VO will always consider your situation and fitment at that point in time while taking a decision.

Having said that, you don't want to have too many rejects and leave it to chance. Every time your visa gets rejected, you must ideally wait for at least a year before trying again just to avoid looking desperate.

All the best for your application!

                          Thanks usvisitor1

I do understand that usually one should wait for before trying again. In my case, I have to be there for few days in this August, otherwise I may have no reason to visit US again anytime soon . So, I decided to take the chance. Most of the people I have talked to have predicted a negative outcome and I do understand it, though I wonder if this system of evaluation is fair.
