  • Please, help...

    Yesterday, I applied for B2 visa to the US. Im 22. I live in Poland. Ive been working as secretary in kindergarten from Feb 2013. I quit studies.
    I really want to visit my friend in L.A. We've got common interests in music. There will be NAMM show in 3 weeks, ive been dreaming to attend for years, and he helped me to get pass for this. Until yesterday, I was convinced visa was an only formality, but i got denied...

    me: in may, in barcelona
    c: how old is he?
    me: 54
    c: what is his job?
    me: music producer
    (he was smiling to me for all this time)
    c: who do you live with?
    me: parents.
    c: how long youve been working and what is your job?
    me: secretary in kindergarten, since Feb 2013
    c: did you study?
    me: yes, i quit, but im gonna start studies again soon
    c: what did you study?
    me: psychology, for year
    c: where?
    me: krakow
    c: unfortunately, your career doesnt satisfy me. get back when you have husband, kids, or have good career. bye.
    me: please...i just want to go there for 10 days...its a trip, i dream about it...
    c: bye.

    There is no much time left. Ive been dreaming about this my whole life and its not sure if there will be another chance. Im ready to apply again this week... my friend wrote a special letter telling them he is going to take care of everything. I have contract of employment.Im ready to enroll for studies.
    What do you think, what would you do if you were in my shoes? Any suggestions? Maybe there are some other documents i should bring? I ask for your help...

    documents are not important.
    Mainly they look at your ties to home country ( job,business, good income, regular study, spouse, kids)
    that will bring you back from US.

    You are very young, not settled in study, job, business and they think you will not come back.

      b1/b2 visa marrying greencard holder

      Hi I am holding a tourist visa entered usa and my girl friend is a greencard holder, can we marry and file my stay for good.

        visa number takes 4 months after you marry a green card holder . By the time you get married, file I-130 and then the visa number arrives , your visitor stay would have expired. Once your stay expires, you won't be able to adjust status to green card. Also it is risky adjusting from tourist to green card through marriage.

        Safer is ;; marry her and then go home , wait for the visa there.

          To elaborate on Peace999's response...if you submit an I-485 package, and the Priority Date is not yet reachable (about 4 months for spouse of a Green Card petitioner), the package will just be returned to you ("rejected" but not denied).

          It's a waste of time trying to convert a new spouse of a Green Card petitioner, as the applicant will be a visa overstay by the time a visa slot is available (Priority Date reachable).

          USCIS is fairly tolerant of such petitions when submitted by U.S. citizen spouses, as the visa applicant is in a "protected" status soon as the Adjustment documents are accepted by USCIS.

          Also, as Peace999 reported, there is a "risk" of trying to "adjust" from tourist visa status. It is done successfuly quite often, but at any time during the process, a USCIS reviewer can decide that the applicant entered the U.S. with "intent" to marry and apply for residency status. Such a decision by a reviewer is articulated as "using the visitor visa to circumvent the normal immigration requirements," and to "gain immigration benefits which the applicant is not entitled to."
