  • Confusing Case of B2 Visa for Mother In Law - Urgent Help Needed

    Hi Guys,

    Quick background about me and my wife .. i am on h1b from last 7 years (GC Applied 2 years back) and my wife has a valid H4 till 2016. My wife got a job in india travelled to europe for here project 6 months back and is now planning to come and stay with me in US for 2 months. We are planning to apply B2 Visitor visa for my MIL (Mother in law) in india.

    My wife's original mother had dies when my wife was 13 years old. My wife got her second mother when she was 15 years old. My wife's birth certificate and passport has her original mothers name (and not current mothers name). Will the VO check the birth certificate and my wife's passport copy to validate the relationship of daughter and mother..??? Please advise as to what documents do we need to prepare so that my MIL can get her tourist visa approved?? My MIL has 1 house (25 lacs) , 1 car and is earning 7 lacs per annum as a lecturer in college.

    as per my knowledge...we cant change the birth certificate as original mother name cannot be changed...do we need to change my wife's passport with current mothers name??? please advise...really stuck ...

    the officer may or may not ask . If he/she does, she must take proof at the interview that she is your wife's stepmother.
    death certificate of original mother( if available) and marriage certificate of step mother to her father.
    No alteration in passport or original BC is possible.

      So only additional documents which my MIL needs to take is Death certificate of 1st MIL and marriage certificate of current MIL.

      1. I just wanted to know how it will be proved that my current MIL is my wife's step mother ???
      2. Shall i sponsor my MIL or i should ask my MIL to sponsor herself for ticket and travel?? (My MIL has a house on her name: 25 lacs, 1 car: 5 lacs and a steady monthly 50k income).

      Please advise. Appreciate your help !!

        the marriage cert will have her dad's name with her step mother's name.
        she can also send a copy of her original bc .

        5L savings and 50k income are not enough. is ur FIL not applying ? that will affect the decision.

          Thanks for your response...

          My MIL is widowed and i don't have my FIL ... another problem is my MIL doesn't have marriage certificate ... and now marriage certificate cannot be made as my FIL is nor more ... will ration card or electricity bill work in place of marriage certificate (Ration card and electricity bill comes has both names ...my current MIL and late FIL)??

          1. I would like to know what options my MIL has now as she not show her relation with my wife since my MIL's marriage certificate is not there.. Can she apply for a tourist visa on her own and show that she is visiting friends in USA??? Please advise.
          2. How much bank balance is needed in her account so that she can apply a tourist visa ?? She has a flat on her name worth 50 lacs and a bank balance of around 15-20 lacs. (6-7 Lacs is per annum income)
          3. My wife is working in europe ... what answer should my MIL give to VO when he/she asks as to where my wife is??? Since she is not in USA will it be an issue during interview?? Please advise ...
          4. VO might ask my MIL if there are any relatives in USA... what should she answer?? does she needs someone to be in USA to go to or she can just go to usa for 100% tourist aspect ... with no relatives in USA (which will not be true as i am here in USA).

            Stepmother issue aside, widows usually find it difficult getting a visitor visa.
            And if they have no children in home country and any child(ren) in US, it becomes even more difficult.
            The reason is simple ; lack of family ties to home country.

            You do not really have to be invited by anybody in US to get a visitor visa.
            People who have nobody in US, go by package tours or by themselves all the time.
            She can do that too, but she will have to go with someone ( going alone is very unnatural )
            and she should have a history of travel to other countries before she applies that way.
            In fact , it may be good her daughter is not in US . They mainly focus on immediate family members in US.
            You will come under "other relatives" which one does not have to specify in the form . Yes if explored more
            during the interview about you , she should not lie.
            Also , about funding , mos ttimes they only ask about income from working age people and if she says 50k, she may just get denied on that
            without being asked about savings.

            Does she have any real children of her own? where are they?

                  Like I said, being a widow is a negative so she stands a chance only if she gets a lot of other factors right.

                  *7-8L /yr salary may be on the borderline for self funding.

                  *apply for US after she has made at least one trip abroad to some country. wait for a couple of months , by that
                  time her daughter will be in US. Then she will have to declare her presence in US in the form and declare
                  the purpose as visiting her.

                  * if she wants to show a package tour, again she must have a history of package tour to other countries llike europe,
                  or SE asia. and she should show package-travel with own-age relatives.

                    I had a similar situation when my mom was refused 5 times at Mumbai consulate despite having taxable income herself and property to prove her ties.

                    Every time I go through the forums and try to perfect my approach to my mom's application, but little success.

                    My advice to all those who try on their own just one thing. if you get it in first attempt that is fine but if refused multiple times as in my mom's case, it is better to seek the advice of a professional.

                    A colleague of mine told about this visa counsellor **** . I was sceptical in the beginning because I did not succeed with one before, but, I had no other option as my mom was being refused with just 2 questions!

                    I have to admit that these people are very professional and gave me a hope. my mom got the visa at the Mumbai consulate on the 6th try much to my relief.
