B2 Visitor Visa Denied. Trying to Re-Apply With in a Week.

  • B2 Visitor Visa Denied. Trying to Re-Apply With in a Week.

    Hi All,
    I have been working in USA on H1B for the last 4 years with a good income and applied for my Mother's visiting Visa.

    Visa Interview happened on 23-Jan-2014 and it was denied.
    Now I'm planning to re-apply for an interview next week and would need one of your suggestions if there is any negative impact due to early interview.

    Below is the conversation.

    Q.Whom are you visiting in US?
    Ans: My Son
    Q. Where does he work?
    Ans: ABC
    Q. Where does he live?
    And : XYZ
    Q. What is your Husband do?
    Ans: He Passed away.
    Q. How many children you have?
    Ans. 2 (1 Son and 1 Daughter)
    Q. Where does your Daughter Stay?
    Ans: Australia.
    Q. Have you ever visited her?
    Ans: Yes
    Q. How many Times
    Ans: 4 Times (In the Span of 9 years)
    Q. How Long have you stayed there?
    Ans: During recent Visit 1year( I guess this is the blunder)

    VO: You are not granted visa this time. You can apply later.

    Australia gives Visiting Visa for a year some times. Unfortunately my mother stayed there for 1year for the first time due to my sisters pregnancy.
    And during all visits she left Australia well before the allowed date to stay. So she is maintaining very good record as per Australian immigration policy.
    We have decent assets(Lands/apartments etc) and financially fine.

    Can you please suggest if my mother can apply for visa again next week?

    Applying so soon will only show desperation and might not go in your favor. The first thing officer would ask what has changed since last time. With the way it is unfortunately, widows find it difficult to get a visitor visa. Especially with your mom having both her kids outside home country doesn't leave any family ties to home country.

    Officers are looking for reasons why a visitor would come back to home country, family ties of the visitor, financial ties of the visitor play a very important role and your mother doesn't seem to be having either.
