    Hi there,

    Please advice -- whether I apply for a visitor visa?

    - I left US on 2010 Dec, while I was on H1B
    - Past employer had filed for Greencard (and I had my I-140 approved in 2010)
    - But I have been out of the US for over 4 years now and now live/work in UK
    - The lawyer confirmed that the I-140 hasn't been withdrawn yet by the employer

    So can I apply for a B2 visa to visit US for a month? Please advice.

    well there is a question on the visitor visa form; has anyone applied for an immigrant petition on your behalf?
    You will have to answer yes. And that will show you had immigrant intent in the past. So it will become diificult for
    you to get a visitor visa. But no harm in trying once . try to show stront ties to UK and convince the officer that
    you do not wish to immigrate to US anymore.

      Hi there - please help me with my situation -

      I left the US in 2010 as my H1 expired while perm was pending - perm got approved in Jan 2016 (after appeal and Judge ruling in my favor) and 140 also got approved recently.

      I applied for B2 in 2014 and was denied as I was between jobs then. (did not know about the appeal - i had forgotten about it)

      I want to visit the US for 3 weeks accompanying my mother who has a B2 and has visited several times. My sister is on GC.

      do I have any chance of getting B2

        Consular officers are not precluded from issuing you a B visa on account of the Form I-140, immigrant worker petition filed for your benefit

        Their decision hinges on you demonstrating strong ties to your home abroad. This burden is higher when applying for B visas than it is when applying for H visas
