Can I apply for a SSN if I'm here as a Tourist B2 Visa?

  • Can I apply for a SSN if I'm here as a Tourist B2 Visa?

    I came to America from South Korea 8 years ago with a tourist visa.
    I was supposed to go back to Korea within a few months but I decided to stay and it's already been 8 years... Now I'm a high school student in America, and I want to work
    in order for me to work I heard I need a Social Security card.
    I have my Tax ID and I paid tax accordingly without a single error for the 8 years I've lived here.
    Am I eligible to apply for a SSN?
    I have a passport with an I-94 form.
    also I was going to go to DHS to get the I-766 form. (EAD or something)
    but I heard I can't apply for that if I'm here as a visitor.. is that true?

    is there no way for me to get green card or a SSN if this is the case?

    You're not eligible for an SSN as a B2 entrant.

        as per your post ,you have not had any legal status for the last 8 years.

        You can only apply for an SSN when you have legal authorization to work.

        are your parents in the same illegal status ? how have you sustained yourself for so long?

          You can also legally work with an interim Work Authorization during your Adjustment of Status processing.

            My parents are both permanent resident. They both have their green cards.
            Now I'm waiting for either one of them to get their citizenship in order for them to apply for my green card since I'm a immediate relative of them.
            I only started feeling the need of a SSN or a green card just recently as I never needed to work or drive since I'm only 17 now.
            My parents are divorced and now I'm in poverty since I'm only living with my mom and she has very low income.. I'm living as a roommate with her in another family's house and now I feel the need of working so I can help my mom.

              If your Priority Date is reachable (and it will be if you are petitioned by a parent with U.S. citizenship), and the Work Authorization form (I-765) is included with the paperwork submitted for you (I-130, I-485, I-864, I-765, I-131), you will get a temporary Work Authorization about 3 months after the conversion package is submitted for you.

                when and on what basis did they get their green cards?

                why did you not get your green card as their child when they got theirs?

                Yes, the only way you can get an SSN and work authorization is when your parents become citizens and
                sponsor you .provided you are still below 21 yrs of age.

                  What is a priority date?

                  my dad will get his citizenship by the end of the year. Once he becomes a citizen, he is planning to apply for my green card.

                  Does that mean i have to wait until the end of the year until he gets his citizenship, and another 3 months after I submit I-765 form in order to get the temporary work authorization?

                  They got their green cards after 5 years of residency in the United States, from what I know.
                  I don't know what specifically happened that stopped my dad from applying for my green card.
                  From what I've heard from my side of the family ( I live with my mom), my dad did not care about me since he has another non blood related family besides him, so he didn't apply for my green card as it's not his business anymore.

                  Once my dad or mom gets their citizenship I'm planning to apply for my green card.
