hi,

I along with my wife and son Got B1/B2 visa in Sep 2007. We went to USA in Sep 2011 and filed for change of status to L1 (for myself) and L2 (for my wife and 8 year old Son) which got approved for 1 year. Afterwards we applied for Renewal of L1 and L2, meanwhile due to my family commitment we withdraw our L1 renewal petition and return to our home country in 2013.
I am planning to travel to US for vacation in Dec 2014 can I still travel on my B1/B2? It is good till 2017. I want to know what is the Status of my visa.

Did you return when your L1 renewal was pending? And had your first L1 I-94 expired?

The best way to see if your B1/B2 still works is for one person to visit US .
Because it is at the US airport the customs will determine if the visa is void or not void .
Go through a place like abu dhabi( etihad airways) where they have the US pre clearance. So if they
turn you back, you will have a shorter journey home.

Yes, we returned to our home country when my L1 renewal was pending. we withdrew our case and we got conformation of withdrawal.

I am in a dilemma, if anyone change B1/B2 visa to L1 visa and if it is approved, then if we are coming back to home country is our earlier B1/B2 visa is valid or is it cancelled as we changed the status .

SInce you returned while it was pending, you did not violate any immigration law .

so your B1/B2 is fine.

Still, like I suggested, the actual confirmation can only be made when you enter US airport or a US pre clearance( abu dhabi).

I need to take one more opinion. when we were in USA and our L1 petition was approved our attorney suggested to file Green card . and as our L1 was approved we thought to go for Green card filing . But, unfortunately our Green card was Denied . and with his suggestion we filed for appeal for our denial. but , as we had to come back to our home country. we withdrew our petition for appeal for green card with our L1 petition.

Now my question is does the filing of Green card or the denial of it will effect applying the Renewal of my 8 years sons B1/b2 visa. as his visa got expired in 2012 when we were in USA.

please guide me .
