  • Is it I-797 0r I-539 approval?

    I was looking at the FAQ on vfs-usa.co.in and it said if you have extended your stay and ur Visa is expired then need to submit I-797 approval during the visa interview. I don't see that form anywhere on INS website also we had applied I-539 for extension and have receipt for approval of extension also, is this the one we need to submit?

    Hi!
    I think if your visa has expired on your passport then you need to submit the Notice of Action. Which is basically your Approval Notice. (I think it is I797).

      I-539 is what you sent to USCIS when you applied for extension.

      USCIS sent you I-797, Notice of Action when it was approved. In other words, extension approval notice is I-797. Look at the sample at https://www.immihelp.com/h4-visa-ext...ice-of-action/ (This sample is specifically for H4. But it is same notice for any visa.)
