  • Question from Peace

Peace, I have recently got married to a US citizen girl and she has filled immigration for me four weeks back. My mom is widow and my younger sister is married and I live with mom. As far as I know they will hardly grant visa to my mom once I will be immigrant or in US. So we are planning to take her visa in advance so she could visit us easily once in a year.

Kindly GUIDE what is the appropriate way to apply for her visa.

    1. Mom will apply to see her brother who is living in US since number of years with his family and kids.
    2. If my married sister apply with her in order to increase her chances.
    3. If I myself apply along with my sister like a complete family visiting US for short trip at uncle's place.
    4. My mom apply with her elder brother who is Doctor and visited US three times before.

These were the available options we thought but there could be another options which you can guide according to your experience.

    Rgds,
    Zain

there is no acknowledgement for my posts so I rarely post here.

Has your mother ever applied for a US visa before? when?
    Has she travelled abroad before?
What is your sister's family's financial status? do they earn like 75k plus per month or less?
Did your US citizen spouse come to your home country to get married to you? When?

First of all thank you for considering.

I have answers of all your questions. Let me answer you in the same sequence.

Has your mother ever applied for a US visa before? when?
Yes, in 1983 she got visa but did not travel then got rejection in 1990, 1996 and recently in Aug 2014. In 80s and 90s she was willing to travel with my dad but Unfortunately my dad got visa everytime but mom just once.

      Has she travelled abroad before?
She has traveled Saudia Arab, Bangladesh and recently again Saudia Arab for Umrah with me and sister.

What is your sister's family's financial status? do they earn like 75k plus per month or less?
My sister's family is healthy enough and earning of her husband is more than 200 k per month because they own business.

Did your US citizen spouse come to your home country to get married to you? When?
My US spouse first came in May 2014 and our families met and decided to get married in Sep 2014. So again she came in Sep 2014 for marriage. In first week of November 2014 she filed my immigration case.

you should not involve yourself in the visitor visa process. You won't get it because of the immigrant petition.

        Since the main focus is your mother's visitor visa, please give more details about her denials. Especially the most recent one. What was her stated purpose ;
was it to meet her brother and was he sponsoring? When did your dad pass away?

Sure I will not involve myself.. Thank you for your guidance.
Her stated purpose was like she wanted to meet her younger brother and his family. My mom owns properties here so she took all the possible evidences. She was prepared to talk with VO regarding she will stay for 3 weeks only but he hardly asked any question and refused under 214(b). I was sponsoring her trip and I earn around 110 k per month and had reasonable bank statement. My dad passed away in 2004

Her stated purpose, she wanted to meet her younger brother and his family. My uncle is living in US since 20 years and never applied immigration for my mom or anyone ever neither my mom had intention to get immigration through him because its a lengthiest way. My mom owns properties here so she took all the possible evidences. She was denied because
              *she is a widow
              *she was applying alone
              * she has a US citizen brother.

Widows do find it difficult though some are successful. There are no guarantees. It is all her luck and hit and trial.

Let your sister plan with her family and your mother. It would be better if your uncle has a major family ceremony coming up like a wedding.
That makes it a natural purpose. If not, they can apply for a month's vacation to US when the kids have vacation next summer. They can apply in March or April.

Peace, you are absolutely right she is widow and brother is a US citizen that was a main reason of denial. It is my mother's last chance that is why I am very concious.

One thing you said very well like she apply during kid's vacation time like in Mar / Apr. My uncle's elder daughter is 16 years old and I am not sure this age will look natural for any wedding / engagement purposes. So your suggestion is that my mother should apply with my sister not with her brother who has already traveled US thrice. I am highlighting this because I have heard that who has traveled US may have more chances to get visa again.

How about this idea to change the scenario like she apply to see my grandmother along with my sister. Does it offend to Visa officer like in Aug 2014 she was going to see her brother and now going to see her mother in law. I am trying to provide maximum information so you could guide with best possible outcome.

Peace, it is totally another window. My paternal grandmother lives in the US and she holds citizenship. She is 80 plus and living in Illinois whereas my uncle is living in Colorado.

Ok , since she is not directly related to your paternal grandmother , it may not be ok to apply with that purpose. Especially when your dad is not there.
She can apply with her brother's family who has already visited US before. She can do it next year.

Peace, what is my mother applies with her brother only. I mean since they charge $170 for each application so it will be quite expensive to apply with his whole family. I had another thing in my mind thought to share with you so you can see if it is workable. My maternal grandmother is also here and she is old like 80 plus so do you think it will be a good idea if my mother applies along with her mother?

She can try, but having been denied before, and being a widow, nothing can be said about the outcome.
