I am new to this but would really like to understand it. Trying to help a friend.
My friend came to US a few years back on a B-2 Visa. He brought his wife and his two children. However, he failed to return to his home country. The B-2 expired.......
His children are now both enrolled in public schools. I don't know how this works, but they are. I guess the rule is that it is not their fault they were brought to this country.
Seeing he is now "illegal", he cannot work. Only under the table I suppose, but he cannot legally work. Because of this, he is depressed. This is where I met him, at a Crisis Center.
His wife is working, but under the table, for she is illegal as well.
The strange part about this is that he returned to his country because of his illness. He had to see special doctors. However, he was allowed to come back not too long ago on a 1 month visa. (Which has since expired)
So, I want to help him. He is afraid to contact anyone to help him reapply or restore his non immigrant status. He thinks he will be deported that same day. He does not want to be ripped away from his family.
What are the options? Does the "Family Interest Directive" might come in to play, but I am not sure that he is considered the "primary caregiver", seeing he does not work, but his wife does.
What steps do I need to take to see if there is something I can do to help him stay with his family and get to work to help provide for them?
All he wants is for he & his family to be able to live in this country, be law abiding citizens, pay their taxes and be happy. (Who doesn't want that, right?)
