  • Please help with some info

    I read few threads regarding the stay of dependent moms. I know US does not have any law that allows parents to stay for long term or add them as dependents. In my case my dad passed away last year and my mom is totally dependent on me now. She has got visitors visa until 2020. But as the rule says she cannot stay in US for more than 6 months and may be few months extension. My question here for anyone who can help me here is that, is there any way i can make her stay with me untill i stay in US or until she has her visitors visa. May be something like a letter from senators or congressman. I do not want to add her as my dependent and i know its not possible. Atleast if she can stay here with me as visitor for a while would be really helpful.

    Even if there is 0.001 % chance to do something, i want to try that. If not my option is to go back to India.

    If you are a U.S. citizen, you can petition mom and adjust her status without her leaving the U.S.

      No i am not a US citizen. Sorry that i didnt mention my status. I am currently in my F1 visa and working with EAD. My H1B will be filed this april. I want my mom to be with me untill next 5 years so that i can sort out many of my issues. I want to know if she can stay for such a long term with B2 visa? With some letters from senators or congressmen.

        Unfortunately there is no such option in your scenario. What you can try is ask her to come and ask for extension once she is here. This may get a 6-10 Months stay at a stretch, but post that advisable she stays out of US for an equally long time.

          Thanks Raghvi. I am doing that for a year now. Considering her health i can no longer expect her travel every 6 months. Just thought if there will be any way out. Ultimately mother is very important compared to comforts and money. So soon i ll fly back to India to be with her. Thanks all for your opinion and advise.

            It doesn't work that way. If your mom comes here on a B2 visa, she may be allowed one extension, after which she must leave the U.S. or she will become a visa overstay.
