    Hi,

    I am filing B2 visa for my mother-in-law and I am her sponsorer.

    I am sharing the following documents with her.
    1. Bank Reference letter - Confirming my current and avg balance for the last 12 months
    2. Last 3 bank account statements
    3. Last 6 Payslips
    4. Employment Letter
    5. I-134 document
    6. Invitation letter
    7. Letter to the Consulate
    8. I-797
    9. My wife's Birth certificate (Q1: I dont have my birth certificate, Is it needed in this case?, pls confirm)
    10. Marriage Certificate

    Q2: This being my first year in US, I dont have Income Tax returns documents. I just have a W2 form. Is that enough?

    My mother in law does not have a strong account statement and the property documents are in the name of my father-in-law(who is not travelling to US due to his work constraints).
    Q3: Can she carry them to the consulate?
    Q4: If she carries them for reference that she would return back to India as her husband and son are in India, would that be ok?
    Q5: Also, would Aadhar card be helpful in explaining that the property documents that she presents actually belongs to her husband?
    Q6: Pls let me know all the documents that she must carry along with her

    Hi

    To be frank, there are no fixed set of documents for B2 visa. In general they want to be sure you have strong ties back home and you are financially well backed to travel to the states and return.

    From what you mention:

    1. Your financial documents are fine.
    2. You said you have a W2. If so you should file your tax returns. Though W2 is helpful. It is best for you to file for returns.
    3. Ensure you are maintaining a healthy balance in your account. I would suggest to give 6 months account statement (if possible).
    4. You dont need your birth certificate. Marriage certificate is enough. However I would advise to give copies of your passports as well (where your names are endorsed as spouses).

    As for your mother in Law:

    1. Ask her to carry any property/financial documents she has. Even if it is in husband's name.
    2. Establish her marriage by providing marriage certificate or passport copies.
    3. Carrying Aadhar card is fine. Not sure how much it will help. Though I would suggest to carry any nomination papers if possible.
    4. Also avoid if she is travelling solely for any pregnancy related assistance. There are high chances of rejection. Keep it a tourism/meeting the family visit.
    5. Since your FIL is not travelling. Explain clearly his work constraints, if the VO asks.
    6. Prepare your mother in law to answer her ties back home, her responsibility towards your FIL, her sons etc.

      My in-laws do not have a marriage certificate. Can you pls suggest any alternatives?

        Marriage certificate is not required if spouse names are there, on the both the passports.

        Date of birth certificate is not required for b2 visa especially for adults. (it may required to kids, below 14 years, to avail some facilities occasionally)

        Anyways, date of birth will be surely there on the passport and passports are issued only after submitting authorized date of birth document.
