  • B-2 Visa for Wife and Kids

    Friends, Need help.

I have never been to US and very confused in US Visa matters and seek advises.

I am working in Japan (From Oct-2013) on a work visa in a multinational engineering company through a consultant (A third party company/Agent) who has office in US and in India. My wife and kids stay in Japan along with me

Now my company (A third party company/Agent) is going to apply B-1 visa for me from India.

    Query:
    Quote:
    1. Can I apply for B-2 visa for my wife and kids in parallel. I will be the one to sponsor there stay. They would like to join me for a month.
    2. Can there be any difficulty due to the fact that we are not staying in India from last 1.5 years.
    3. As I was not working in India, I didn`t apply for Tax returns from last 2 years, Will this be a problem, Though I have 1 property in my Name and 1 in my wife`s name in India to show as a reason to return back, apart from my parent and my wife`s parents. Will that be an adequate reason.
    4. Any thing else which I need to consider while applying for them
    Unquote

    Thanks,
    Amit

The most important considerations will be -

    1) Do you have a genuine reason to go to the U.S. on a B-1 business visa? And can you and your company substantiate it?

    2) Do you have a stable job in Japan with a good income?

If you can provide evidence for the above 2 factors your chances and your wife's/children's chances of getting a visa increase. Forget property in India - most likely won't be seen and won't make any difference.

B-2 Visa for wife and kids

      Friend,

First of all many thanks for the reply.

      1. I am asked to go to USA (From Japanese company) for an inspection which will continue for about 5 months.
Now, as I already mentioned that, I am not a permanent employee of Japanese company, They asked my Agent (Third part company through which, I am working in Japan) to arrange B-1 visa for me. I will get the invitation letter from my agent who have there office in USA, the company where I am invited to perform the inspection as well as from my japanese company stating the kind of work I am asked to perform.

      2. Job is very stable in Japan and yes..with good Income.

Keep in mind that B1 visa can be used only for certain purposes such as business meetings, training etc and the letter should not indicate any other activities including working there.

As per your situation, it's not a good idea to apply together.

You may apply for them on your next visit, if you get the visa.

This is my opinion, not a legal advice.
