  • Help Needed ASAP

    Hi,

I have a B2 visitors visa that expires on Feb 1 of 2006. I want to go visit the US on Jan 11th 2006. Will i be able to get in at the port of entry? or will they return me back home? Should i get a plane ticket till Jan 29th or it will not matter? will i be considered as "OVERSTAY" if i stay past FEB 1st 06?

I have visited the US on the same visa during the summer for less then 3 month. I didnt understand what the I-94 form on my passport was, so i didnt look at when i was suppose to leave. When i exited the US they didnt tell me that i over stayed or canceled my visa. How would i know if i over stayed or not? Please advice As i want to get my ticket very soon

Your help in this matter is greatly appreciated!

    Hi!

I think the duration of your stay is determined at the port of entry. If you entry US on Jan 11th and at the port of entry they stamp a 6 months stay on your I-94 then your stay would be legal until that date even though the visa on your passport has expired. BUT in this case please keep a copy of your I-94 with you to prove you didn't over stay.

I don't think there is a way to track if you overstayed or not. Usually visitor visa is granted 3-6 months so you might have not overstayed.

Thank you for you promptly reply.

I am very scared to take a 14 hours trip just to go see the airport and turn arround.

Will be safe if i get a Plan ticket for 2 month? or should i just get it till before Feb 1st. I dont want the officers to think my intensions are to stay in the US when i am just comming to visit.

You can enter US before your visa expiry date. POE officer stamps your duration of stay on your I 94 attached to the passport. Keep a copy of your I-94 before your exit from US in the future.

Normally they give a 6 month stamp.

          Port Of entry

Can anyone tell me another thing please!

Does it matter how far from your experation date you enter The US? For example, Going 3 month before the experation day or 3 weeks before the experation date of my B2 Visa?? Do i have anything to worry about

I am very insecure about this!

          Your responce is greatly appreciated!
