  • Which VISA to apply for that best fits my circumstances?

    I'll try to explain as easy and quickly as I can, I could write two pages full to explain my situation, but that won't be useful.

    I'm 22 now, Brazilian. Parents took my entire family over to the US when I was 11, stayed after our visa's expired. Two sisters are now US citizen's, one married, other single. I returned with my father when I was 18, four years ago. I'd like to visit my sisters, but I fear if I apply for a tourist visa they'll think I plan on staying over there once again (although it wasn't my choice to be taken over there). Unsure what to do on that part. Now, I have a friend I've known over 6 years, we talk everyday and I guided him into creating his own business, which is now around 500k+ a year, we started another online business together, for now he's the sole owner, he will be registering the business soon, I'm owner of a successful online business, would that help and might I apply for a different type of visa in this case? We talked about it, unsure how sponsoring goes for friends/business partners.

    I'd appreciate some guidance.

    Since you overstayed in the US for over 1 year, you are banned from entering the US for 10 years. You still have 6 years to go.

    After that, what visa you apply for depends upon your purpose of traveling to the US.

      I thought that unlawful presence only accrued for adults(over 18), not minors. I know my visa is invalid as I overstayed, that law is set for everyone.

      I went in 2005 at the age of 11, left 2012; a few months after my 18th birthday. If that law is valid that one stars accruing unlawful presence after the age of 18 , then I only accrued at the most one year (putting 1 year as I don't recall the exact months of arrival/departure), and if it stands, that debt would have been paid correct, unless the law has changed, then in that case.. shucks.


      Depending on your circumstances and close relations to U.S. family, you may be "forgiven" for overstaying a temporary visa, and obtain a green card.



      And a couple of other sources not mentioned, but those date as far as 1 year back.
