Claiming tax benefits on visitors

My parents visited last year and were here for 6 months and I would like to make a tax benefit claim.

What is the relationship? None other than Spouse, children can be claimed as dependents.

If they are your dependents, they illegally entered the US on visitor visas due to fraudulent statements in order to get the visas.

They - and you - are NOT eligible for US tax benefits for them.

Why? The spouse of a H1 holder can legally apply for a B1/B2 visa and visit for couple of months with nothing being illegal about the visit.

Claiming tax benefits for visiting parents is not allowed. I have confirmed this with a CPA.

If you do indeed support ...

... your parents or your spouse's parents, then they need to be in the US for six months + 1 additional day.

This allows you to apply for and get a tax identification number from the IRS.

You can use this to claim them as your dependants.

You need to actually support them by financial means with your monies coming from US or your home country.

However, be aware that if you misrepresent any of the facts, you're liable to be prosecuted and may have to face jail terms.

Talk to your CPA and to IRS.

Do not take any body's "free" advice for granted, that includes myself too!

The above scenario has been observed with quite a few individuals and IRS has approved the same.
