If she came here on a B1/B2 visitor and tourism visa and the I-94 dates have expired already, she is accruing unlawful presence. She would as soon as possible want to return to her home country to avoid any further overstay. Unfortunately, depending on how long she has already stayed past her I-94 dates she may be banned from returning to the U.S. either with a 3 year or 10 year ban. If she and the U.S. citizen are planning on marrying, then they would marry and file for her adjustment of status.Originally posted by Kenta Kuwata View PostI have a friend who is a Japanese citizen, she got pregnant while on her stay in america and she is still in the US, the father of the unborn child is an US citizen, what can.
