  • Tourist Visa holder planning to get married in the US

    Hi, would like to ask legal assistance. I am a Filipina and have a 10 year US Visa which is expiring on Dec 2017. My Fiancé of 2 years and I are planning to get married in Hawaii
    (he lives there) this coming June. I will only be there for a week and will have to go back to the Philippines for work and because our daughter is here as well.
    Can I get married on a Tourist Visa?
    Can I go back home to the Philippines after getting married?
    What do we need to do and file (documents) to change my status after getting married? and can we do that even I am back to my home country?
    If I go back to the Philippines after the wedding, can I still go to the US to visit my future husband anytime after the wedding?

    It's perfectly fine to enter as a visitor to get married and then leave, though it's possible to be denied entry if they are not convinced that you will leave, since your spouse is living in the US.

    It may be harder to enter the US as a visitor in the future when you are married to someone living in the US.

    If you want to get permanent residency from outside the US, the procedure is, after the marriage, your spouse files an I-130 petition, and then after that is approved, you will deal with NVC and the US consulate in your country to get an immigrant visa.

      Hi Thank you for your reply.

      I read a couple of blogs and related articles on the internet and they suggested to get Fiancé visa or spousal visa.

      I have another question:
      1. If I have a Tourist Visa and decide to get a Fiancé Visa - whats gonna happen to my tourist visa?
      2. If we get married here in the Philippines and apply for Spousal Visa after, can I still visit the US using my Tourist Visa while waiting for the approved spousal visa?
      Or I cant visit the US at all while the spousal visa is still in process?

        1. Prior to actually getting the fiance visa, nothing. They will probably cancel the visitor visa when giving you the fiance visa. But even when before getting the fiance visa, even though the visitor visa is not cancelled, there is still a big chance of denial of entry for someone who is going through the process to get a fiance visa.
        2. Again, it all depends on the officer at entry. You "can", but the chance of denial of entry is high.
