Please help me in getting us visitor visa(b2) for my uncle(my father's brother)

  • Please help me in getting us visitor visa(b2) for my uncle(my father's brother)

    Hi,

    I need to invite my uncle (my father's brother) to USA on a visitor visa(B2) for one month.

    Here is what I need to know before I apply us visitor visa for him.

    1.)My uncle is 70 year old .He is married but not legally separated from his wife. His wife name is also not included in any of his document(including Passport ,pension book etc) as they got separated after one or two year of marriage .
    Since none of his documents shows that he is married. what should I select while filling Ds160 form. Is it fine if I select single marital status? If I select married then visa officer may ask where is his wife and all those questions.

    2.) My uncle stays with my family (i.e my mom,dad,my brother and his family ) in india in the same house(joint family). He has his own property which he gave on rent to someone and he also gets pension and all. Are these things sufficient to prove his strong ties to homeland country.?

    3.)I am planning to send one letter(may be invitation letter) indicating that my uncle will take care of expense for flights and I will take care of his rest of the expense.
    Can I sponsor my uncle visa or he should sponsor his own visa Please suggest what should I do.

    4.)Since we are his family and he has been staying with my mom and dad for the past 30 yrs ,so at the time of visa interview if visa officer will ask whether he has any family or not in india then what answer he should give.
    How to make them believe that he will be definitely return to india after one month.

    4.) what are the chances of getting his visa.
    Please suggest something so that he gets visitor visa.I really want him to come here and visit us(my husband and me) as he treat us as his own kids .

    1. He can choose 'Separated' status.
    2. That is hard to say for sure.
    3. If he can take care of all of his expenses, that is the best. Otherwise, you have to show that you are willing to do so.
    4. He can explain the truth and hope for the best.

      As he is 70 years old the probability of settling down in US is virtually non-existent so in my opinion he has a good chance of getting the visa.

        Thanks for your response but have some more queries

        In DS 160 form the options for Marital status are Divorced, single, Widow and Legally separated. He is not legally separated from his wife.Is it correct to select Legally separated option ?we don't have just separate option in the drop down of marital status on Ds160 form.
        As we don't have any separate option for marital status on Ds160 form that's why I was thinking of selecting single because none of his documents shows he was married .But if I select single then this shows that he doesnot have strong family ties in india.Please help me


        Also I am willing to sponsor his visa as I am working here in US and I can take care of all his expenses. I was thinking if I sponsor then the visa officer might understand that he has a close relation with her niece. I was in the assumption that it would help him in getting us visa. Please suggest me what should I do

        My uncle has one daughter and she is married. although they are not in touch with each other(i.e my uncle and his daughter) but if visa officer ask him whether he has any family in India or not then is it fine if he tells them that he stays with his brother's family and he has one daughter and is married. Does my uncle need to carry any proof at the time of interview to show the visa officer that he has one daughter.Please suggest. Please note that this we can tell only if we select marital status as married.

          Thanks for your response .

          Yeah. he will definitely go back to india .but like in my original post as I mentioned I am confused about the marital status and his family.so I am not sure if this will crete any hurdle for him in getting us visa. I am thinking of inviting him only for 4 weeks so that visa officer approves his visa.
          I am not sure what points I need to consider to make his case strong.

            Marital status does not matter in his case due to the age factor. He can choose 'Separated' or 'Never married'. Think of all possible questions VO can ask and conduct couple of mock interviews, it helps immensely.
