Hi, my name is Tanveer. I am US citizen. My mother holds a visitor visa for US. She completes her 6 months in US on July 30th. If I apply for her green card now and get the receipt letter before she leaves can she stay in US until her application is processed? Or will she have to leave the country due to the fact that she completed her 6 month stay in US? Please advice. Thanks

She can stay. In fact, if she applies for adjustment of status she must stay until her advance parole is approved, which might take 4 months or so. If she needs to travel abroad before then, her application will be deemed abandoned and she'll need to wait to obtain her immigrant visa at the consulate abroad

I-751 Remove conditions.
Hi, I send to USCIS on June 27th 2017 the petition I-751 to remove the terms and conditions in the green card. Which is approximately 8 days ago. I checked my bank account and they haven't taken the payment yet. Does anyone now when will they take the payment, and how long will it take until I get a notice by mail?

Being an immediate relative of US citizen, your mother need not be in status to file for a green card. So it does not matter whether you apply within her 6 month legal stay period or not. She only needs to have been legally admitted (which she did on her visitor visa) for her to be eligible to file GC.Originally posted by tanveer236 View PostHi, my name is Tanveer. I am US citizen.
