  • Entering US from a different country other than nationality

Hi there, thanks for considering my question.

I am looking for some reassurance about my wife's situation. We live in Brazil and will be visiting the UK for 5 weeks in December. We are regular travellers to Europe (twice per year) and have been to Orlando in 2015. Whilst in the UK, want to take a short 3 day trip to NYC before returning to the UK and then returning to Brazil a few days after that.

I have a British passport with ESTA clearance.
My wife has a Brazilian passport that is newly issued, but her expired passport contains a 10 year US visit visa that was issued in 2015 (so has 8 years remaining). She will carry both with her.

My concern is about her entering the USA having travelled from the UK, rather than Brazil and, in addition, having a valid visit visa in her old passport. Does anyone have any comments about that situation?

No concerns. You should be fine.
Just an opinion; Not legal advice.

No issues. People from Brazil always carry the visa in the old passport and the new one. Common procedure as the visa is not tied to the passport. No problem in arriving from different country. Some question on the purpose of the trip to UK and back to UK and then to Brazil will be made but since it is all tourism, you will be fine. Actually, probably is even cheaper to buy round trip tickets! People from Brazil travel a lot to Europe and US and make all crazy combinations of stops in between...advantages of having 30 days vacation/year

Yes, I'm anticipating this line of questioning as it's not that common to go back and forth across the Atlantic in this manner. We booked the trip to the UK a long time ago. However, the BA airline has just announced a sale so we have jumped on some affordable flights to NYC. Living in Brazil, there is only one flight a day from Rio to NYC and it's about 4 times more expensive than a flight from London (from where I estimate there are some 30 flights a day to JKF competing for passengers). So, it's really just a matter of opportunity, good price and having the time and inclination to do this.

Thanks to everyone for their comments.
