  • B2 visa rejected

    Hello All,

My wife-to-be applied for a B2 tourist visa so she can come meet me in person here in the USA, but, the consulate officer denied her visa saying that she needed to apply for a K1 visa if she is going to meet her fiance',

But, I'm not a US citizen, and now I wonder how she can apply for a K1 visa. Please let me know your thoughts

She can't apply for a K-1. What is your status?

She can apply for K1 after you two get married, engagement has neither legal nor cultural sanctity from American standpoint. If your fiance still wants to go ahead and retry B2, please do not mention meeting you as the purpose of the visit.

Only US citizens can file Alien Fiancee Petitions

OP did she mistakenly imply that you were a US citizen? Was she clear that her trip was of a temporary nature?

Overcoming the presumption of immigrant intent is a big hurdle for B visa applicants to overcome. You should be prepared to travel abroad to meet her if she can't get B visa after repeated attempts, and possibly consider marrying her so she can a get dependent visa

Someone cannot apply for K-1 after getting married. Also, K-1 is for fiances of US citizens, which the OP has said he is not.
