different name on passport and visa

Hi,

Can someone help me with this inquiry? My 4 and half year old nephew got his first name changed in his passport(got issued a new one) but his old passport has a U.S. visitor visa in it with his original name. His visa is valid for another 2 years. Do we need to apply for a new visa for the new passport or we can present a legal affidavit for a name change and keep both passport during our journey.
